What are Sample Briefs?

The following opening brief samples have been designed and are provided for individuals who are filing a brief on their own behalf. You are advised to review the Oregon Rules of Appellate Procedure (ORAP) and Oregon Revised Statutes (ORS) for additional information on filing requirements and filing deadlines.

If you are self represented, only the original document is required.

If you are an attorney, only the eFiled document is required.

The instructions below are helpful to get your brief under 25MB. If you have tried all of these options and cannot get your brief under 25MB, you must eFile a letter stating that and request that the court accept the brief in two separate PDFs. The letter must be eFiled separately from the brief. Both the letter and the brief must be eFiled at the same time.

Brief / Excerpt of Record over 25 MB

  • Change setting on scanner to scan as text instead of as an image (image comes in as JPEG which is too big) (old scanners might not have an option to change setting).
  • If Excerpt of Record is text searchable it might make the MB too big. Only the brief is required to be text searchable.
  • Lower the resolution. Higher resolution for sharper images isn’t necessary.
  • Once the brief and excerpt of record are combined, in Adobe click “flatten” or “merge and flatten” which will make the document MB smaller.

No. The excerpt of record must be eFiled as a part of the brief as one PDF. If the excerpt of record is eFiled as a supporting document, the brief and excerpt of record will be eFiled as two separate documents. The brief must be eFiled as one PDF document.
