Committee members sitting at a conference tableThe Oregon Rules of Appellate Procedure (ORAP) are adopted by the courts pursuant to statute.  See ORS 2.120 (Supreme Court); ORS 2.560(2) (Court of Appeals).  The Chief Justice and the Chief Judge also have authority to promulgate temporary amendments to the rules.  Those temporary amendments expire unless subsequently adopted through the ORAP Committee process.

To advise the appellate courts in developing the rules, the Chief Justice of the Supreme Court and the Chief Judge of the Court of Appeals have created the ORAP Committee.  The committee, which is an advisory body only, has a voting membership that consists of appellate judges, attorneys, and a trial court administrator.

Currently, the committee meets in even-numbered years to consider proposals to permanently amend the rules.  The committee's draft proposals are published for public comment during the summer.  After the committee has reviewed the public comments, the committee prepares final proposals that are submitted to the appellate courts for their consideration. Those permanent amendments adopted by the courts become effective on January 1 of the following year.

To contact the committee to propose an amendment to the ORAPs, see the contact information for the committee here.  Committee meetings are public; for information about committee meetings, including agendas, minutes, and how to attend, see here.
