Policy of Nondiscrimination on the Basis of Disability


The Oregon Judicial Department (OJD) does not discriminate on the basis of disability in admission to, access to, or operations of its programs or services. Under Title II of the ADA, each OJD program or service, when viewed in its entirety, will be readily accessible to and usable by qualified individuals with disabilities—unless doing so would cause a fundamental alteration in the nature of its program or service or would result in an undue financial or administrative burden. Each court will provide, at state expense, appropriate auxiliary aids and services, including sign language interpreters and assistive devices, to participants in court proceedings who are deaf, hard of hearing, or have other communications disabilities.

Requests for accommodations must be received as soon as possible, but not less than two business days before an activity or event.

Internal ADA Grievance Procedure for Public Access Issues

The OJD has adopted an internal grievance procedure providing for prompt and equitable resolution of complaints alleging Judicial Department discrimination on the basis of disability in violation of the U.S. Department of Justice regulations implementing Title II of the ADA. This Procedure has been developed to comply with 28 CFR 35.107(b).


Filing of Complaint

  1. Complaints alleging discrimination by the Judicial Department or its employees on the basis of an individual's disability:
    • Should be filed as soon as possible but no later than 45 calendar days after the alleged violation;
    • Filed in writing, dated and signed by the individual alleging discrimination or by the individual's authorized representative (upon request, other alternative means of filing a complaint will be made);
    • Contain the name, address, telephone number, and e-mail address of the individual (and representative, if used) filing it;
    • Describe briefly, but with sufficient detail, the circumstances of the alleged violation of the regulations. Indicate the date, place, and nature of the occurrence. Include the names, if known, of any official or employee involved, and the names of any persons witnessing the event; and
    • Indicate recommended corrective action that may resolve the alleged violation(s).

  2. Complaints should be filed at the local level of the Judicial Department with the following person(s) who has been designated to coordinate ADA compliance efforts:

    All complainants will be notified in writing by the above named person of the receipt of the complaint.

  3. An investigation, as may be appropriate, shall follow a filing of a complaint. An investigation will be informal but will afford the complainant and their representatives, if any, an opportunity to submit information or evidence relevant to the complaint.

  4. A written determination as to the validity of the complaint and a description of the resolution, if any, shall be issued and a copy forwarded to the complainant no later than 45 calendar days after its filing.

  5. The local administrative authority shall maintain the files and records relating to complaints filed for a period of three years.

    Request of Reconsideration

  6. A complainant can request a reconsideration in instances where he or she is dissatisfied with the written determination or resolution. The request for reconsideration should be made within 45 calendar days of issuance of the written determination and filed with:

  7. A written response on the request for reconsideration shall be issued and a copy forwarded to the complainant no later than 45 calendar days after its receipt.

  8. The Office of the State Court Administrator shall maintain the files and records relating to any request for reconsideration filed for a period of three years.

Use of the Judicial Department grievance procedure in no way impairs an individual's pursuit of other remedies under the ADA such as filing an ADA complaint with the responsible federal department, agency, or court.
