Divorce, Separation, Custody and Support

Assistance is available for people who want to file court papers for divorce, custody and support through the Family Law Department.  To make an appointment, please call 503.373.4349. 

Forms Available Through the Oregon Judicial Department

If you want to have your documents reviewed prior to filing and choose to use the Interactive Guide and File Interview available on the Oregon Judicial Department’s website, you must save your interview and print your forms without submitting your filing.  Please bring your completed forms to your document review appointment.  If you complete the Interactive Guide and File Interview and submit your filing electronically, we are not able to review your forms.

Forms are available through the Oregon Judicial Department for filing for:

  • Divorce
  • Custody
  • Parenting time and support
  • Sex Changes
The Family Law department reviews all completed paperwork by appointment or walk-in. We make every effort to assist walk-in customers, but depending on our staffing cannot guarantee that you will be seen without an appointment. Appointments are available between 8:30 a.m. and 4 p.m. and can be made in person or by phone. Children are not permitted at the document review appointment.

 

Fee Deferral Requests

A request to waive or defer the payment of filing fees and costs to a later date may be made by filling out and filing the forms.

Request for Extension of Time

If you have received a notice from the court saying your case will be dismissed because you have not filed a proof of service or have not requested a default, forms are available below to request an extension of time.  These forms are only necessary if the time stated in the notice does not give you enough time to submit a proof of service or paperwork to request a default.  For more information, contact the Family Law Department at 503.373.4349.

Name Changes

An attorney can prepare the necessary paperwork for a name change. If you choose to try to obtain a name change without an attorney, Marion County has prepared a detailed set of forms and instructions for name changes. The instructions explain which forms you will need, how to fill them out, and how to file them. There is one set of forms and instructions for adults, and another for minors. While you can also prepare your own name change paperwork, the court prefers that you use the forms developed by the court. You may purchase hard copies of the forms and instructions from the family law department at the courthouse for 25 cents per page.
